This court document filed by Judge Stadler, in the District Court of the Eleventh Judicial District of the State of Montana, is dated September 28, 2007. This was the final Judgment and Sentence summarizing my charges, restitution and probation conditions in my State (Criminal) case.

Oddly, the same probation conditions and, more importantly, the fact that they could not be enforced in Canada, was the excuse the Flathead County authorities used during my first sentencing to pull out of our signed plea agreement, but somehow now, three months later, that was no longer an issue.

'The Defendant is to be given credit for 265 days served in custody pending his May 21, 2007, sentencing.' comment (Page: 6): As a detainee, I was entitled to receive $50 per day or $13,250.00 for 265 days spent in custody. So where did that money go?

Well, the judge cleverly absorbed my credit into my fine by increasing my fine to $23,250.00 and then deducting $13,250.00 from it to arrive at the nice round number of $10,000.00 as my net fine.

Why do they even have a daily per Diem for detainees if the judges are just going to get around the law by playing with numbers and making their own rules?
